Terms & Conditions — Custom Case Kiosk (“CCK”)

Effective date: October 22, 2025

Welcome to Custom Case Kiosk (“CCK”). These Terms & Conditions (“Terms”) govern your access to and use of our kiosks, websites, mobile experiences, and related services (collectively, the “Services”). By using the Services, you agree to these Terms.

1) Acceptance of Terms

By accessing or using CCK, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2) Who May Use CCK

You must be at least 13 years old (or the age of digital consent in your region). If under 18, you confirm you have permission from a parent or legal guardian. Business users represent they have authority to bind their organization.

3) Accounts & Security (when applicable)

Some features may require an account or contact info (e.g., receipts, reprints, support). You are responsible for safeguarding your credentials and all activity under your account.

4) Your Content & License to Print

• Ownership: You retain ownership of your User Content.

• License to CCK: You grant CCK a worldwide, non-exclusive, royalty-free license to use, reproduce, and display your User Content solely to provide and improve the Services (processing, printing, QA, fraud prevention).

• Marketing use: We will not use your User Content for advertising without your explicit, separate consent.

• Warranty: You warrant you own or have rights to all User Content you submit for printing.

5) Prohibited Content

Do not upload or request prints that infringe rights; depict or promote illegal activity; sexual content involving minors; hate, harassment, or explicit violence; contain malware; or violate law, venue policy, or card-network rules. CCK may refuse, cancel, or remove any order/content at our discretion.

6) Moderation & DMCA

We may use automated and/or human review. Rights holders may report alleged infringement; we respond to valid notices and may disable or refuse content.

7) Device Fit, Colors & Materials — Print Disclaimers

• Device compatibility: You’re responsible for choosing the correct device model.

• Color variance: Printed colors may differ from on-screen previews.

• Cropping/placement: Minor shifts can occur during production.

• Protection claims: Cases offer everyday protection; CCK isn’t liable for device damage.

8) Orders, Pricing, Taxes & Payment

Prices, taxes, fees, and available models are shown at the kiosk or online and may change. You authorize charges to your selected method. Sales tax is collected where required.

9) Refunds, Reprints & Returns

Because each order is custom-made, all sales are final. We may reprint or replace a product with a manufacturing defect or print error if reported within 7 days with proof of purchase and photos. Exclusions: low-resolution images/typos/user choices; normal variance or minor tolerance; misuse or wear-and-tear.

10) Kiosk & Venue Rules

Follow posted rules. We may pause or refuse service for safety, maintenance, or policy reasons.

11) Privacy & Data

We collect limited data to operate the Services in accordance with our Privacy Policy. By using CCK, you consent to such processing.

12) Intellectual Property (CCK)

The Services, software, designs, branding, and content (excluding User Content) belong to CCK or its licensors. You may not copy, modify, distribute, reverse-engineer, or create derivative works except as permitted.

13) Third-Party Services

We may integrate payment processors, hosting, or analytics; their terms and privacy practices apply.

14) Warranties & Disclaimers

THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, CCK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

15) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CCK AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE. CCK’S TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE ORDER GIVING RISE TO THE CLAIM.

16) Indemnification

You agree to indemnify and hold harmless CCK and its affiliates from claims arising out of your User Content, use of the Services, or violation of these Terms or law.

17) Termination & Suspension

We may suspend or terminate access at any time for any reason, including violations or suspected fraud/abuse.

18) Changes to the Services or Terms

We may update the Services and these Terms. Continued use after changes take effect constitutes acceptance.

19) Governing Law & Venue

These Terms are governed by the laws of the State of California, USA. You agree to the exclusive jurisdiction and venue of the state or federal courts located in San Bernardino County, California.
