TERMS & CONDITIONS - CUSTOM CASE KIOSK ("CCK")
Welcome to Custom Case Kiosk ("CCK", "we", "our", or "us"). These Terms & Conditions ("Terms") govern your access to and use of our kiosks, websites, mobile experiences, and related services (collectively, the "Services"). By accessing or using the Services, you agree to these Terms.
ACCEPTANCE OF TERMS
By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
WHO MAY USE CCK
You must be at least 13 years old (or the age of digital consent in your jurisdiction). If you are under 18, you represent that you have permission from a parent or legal guardian. If you are using CCK on behalf of a business or organization, you represent that you have authority to bind that entity.
ACCOUNTS & SECURITY (WHEN APPLICABLE)
Some features may require you to provide contact information or create an account (e.g., receipts, reprints, support). You are responsible for safeguarding your credentials and for all activity associated with your account or contact details.
YOUR CONTENT & LICENSE TO PRINT
Ownership: You retain ownership of any images, designs, text, or other materials you submit ("User Content").
License to CCK: You grant CCK a worldwide, non-exclusive, royalty-free license to use, reproduce, process, and display your User Content solely to operate, provide, maintain, and improve the Services (including printing, quality assurance, troubleshooting, and fraud prevention).
Marketing use: We will not use your User Content for advertising or promotional purposes without your explicit, separate consent.
Warranty: You represent and warrant that you own or have all necessary rights to submit and print your User Content.
PROHIBITED CONTENT
You may not upload or request prints that:
Infringe intellectual property or privacy rights
Depict or promote illegal activity
Contain sexual content involving minors
Promote hate, harassment, or explicit violence
Contain malware or harmful code
Violate applicable laws, venue rules, or payment-network requirements
CCK may refuse, cancel, or remove any order or content at its sole discretion.
MODERATION & DMCA
We may review content using automated tools and/or human review. Rights holders may submit infringement claims, and we respond to valid notices in accordance with applicable law. Content may be disabled or refused as required.
DEVICE FIT, COLORS & MATERIALS - PRINT DISCLAIMERS
Device compatibility: You are responsible for selecting the correct device model. Color variance: Printed colors may differ from on-screen previews. Cropping and placement: Minor shifts may occur during production. Protection claims: Cases provide everyday protection only; CCK is not responsible for device damage.
ORDERS, PRICING, TAXES & PAYMENT
Prices, fees, available models, and taxes are displayed at the kiosk or online and may change without notice. By placing an order, you authorize CCK (and its payment processors) to charge your selected payment method. Sales tax is collected where required.
REFUNDS, REPRINTS & RETURNS
All products are custom-made and all sales are final.
We may offer a reprint or replacement for a manufacturing defect or print error if reported within 7 days of purchase with proof of purchase and clear photos.
Exclusions include: low-resolution images, typos, or user design choices; normal print variance or tolerances; misuse, abuse, or normal wear and tear.
. KIOSK & VENUE RULES
You agree to follow all posted kiosk and venue rules. CCK may pause or refuse service for safety, maintenance, technical issues, or policy reasons.
. PRIVACY & DATA
We collect and process limited personal data as described in our Privacy Policy. By using the Services, you consent to such processing.
. INTELLECTUAL PROPERTY (CCK)
All software, hardware configurations, designs, branding, content, and materials related to the Services (excluding User Content) are owned by CCK or its licensors. You may not copy, modify, distribute, reverse-engineer, or create derivative works except as expressly permitted.
THIRD-PARTY SERVICES
The Services may integrate third-party providers such as payment processors, hosting platforms, analytics tools, or messaging services. Their terms and privacy policies apply to your use of those services.
. WARRANTIES & DISCLAIMERS
THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, CCK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CCK AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE.
CCK'S TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE ORDER GIVING RISE TO THE CLAIM.
. INDEMNIFICATION
You agree to indemnify and hold harmless CCK and its affiliates from any claims, damages, liabilities, or expenses arising out of your User Content, use of the Services, or violation of these Terms or applicable law.
TERMINATION & SUSPENSION
We may suspend or terminate access to the Services at any time for any reason, including violations, suspected fraud, or abuse.
. CHANGES TO THE SERVICES OR TERMS
We may modify the Services or these Terms from time to time. Continued use after changes become effective constitutes acceptance of the updated Terms.
. GOVERNING LAW & VENUE
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. You agree to exclusive jurisdiction and venue in the state or federal courts located in San Bernardino County, California.
